Protecting investments for over 20 years

At the law firm of Andrew Toft, I have provided service and support to bankers, creditors, and mortgage companies. If your institution has a watch list that they want to decrease, I can help. Contact me, Andrew Toft, for an initial consultation.

Bank Fraud

Fraud is very harmful to banks and other commercial lenders. Depending on the scope of the fraud, the financial damage can sometimes pale in comparison to the long term damage to an institute's reputation. I have been assisting banks with fraud issues for a long time. Before I became a solo practitioner, I worked in-house for a bank on fraud issues such as

  • Check kiting
  • Check forgery
  • Employee theft

If you suspect that you are a victim of fraud, you need to take action right away. With my familiarity with the banking industry, I can work to help you minimize your losses.

General Litigation

I assist lenders with contract disputes and other civil actions, including

  • Breach of contract
  • Lender liability
  • The developing claim of deepening insolvency

Commercial Bankruptcy

I also assist lenders with bankruptcy issues. If a debtor or mortgagor has financial difficulties and starts getting behind on payments, I can help. I can help with a workout situation when avoiding bankruptcy is the highest priority.  Alternatives include

Collection Litigation, I can sue a debtor to collect on the debt.

Developing a workout strategy. I work with both you and your debtor to devise a workout strategy. I can assist you in finding alternatives to both litigation and bankruptcy. This may include refinancing, or restructuring the loan. Other options may involve including additional collateral, changing the promissory notes, or bringing in a subordinate lender.
